    LAS VEGAS TRUCK ACCIDENT INFORMATION

Nevada's Freight Corridors and the Crashes They Cause

Nevada sits at the crossroads of the American West’s commercial freight network. Interstate 15 connects the Los Angeles ports to Salt Lake City, carrying heavy commercial truck traffic through Clark County every day. The I-215 Beltway serves the growing warehouse and logistics corridor near the Apex Industrial Park in North Las Vegas. US-95 links Las Vegas to Reno and beyond through central Nevada’s open desert. I-80 carries transcontinental freight through Reno and Sparks, passing the Tahoe Reno Industrial Center.

These routes are essential economic arteries. They can also be dangerous for passenger vehicles. When a commercial truck driver is fatigued, distracted, improperly trained, or operating a poorly maintained rig, the resulting crash is rarely minor. Head-on collisions, underride accidents, jackknife crashes, and rollovers on Nevada’s high-speed desert highways can produce catastrophic and fatal injuries.

Nevada follows a modified comparative negligence rule under NRS 41.141. If you are found 50% or less at fault, you can still recover compensation, reduced by your percentage of fault. If you are found 51% or more at fault, you cannot recover damages. The statute of limitations for personal injury claims is generally two years from the date of the crash under NRS 11.190(4)(e). Waiting even days can result in the loss of critical electronic evidence, so it’s best to contact us as soon as possible after a trucking accident.

Who May Be Liable in a Nevada Truck Accident

    • The truck driver — fatigue, distraction, impairment, or reckless driving.
    • The trucking company — negligent hiring, inadequate training, FMCSA violations, pressuring drivers to exceed hours-of-service limits.
    • The freight broker — hiring unsafe or unvetted motor carriers.
    • The cargo loader or shipper — improper loading, unsecured freight, overloaded trailers.
    • The vehicle manufacturer — defective brakes, tires, steering systems, or ECM malfunctions.
    • Third-party maintenance contractors — negligent inspections and repairs.

    What Compensation Can You Recover?

Nevada law allows truck accident victims to pursue full economic and non-economic damages. In cases where carrier conduct was particularly reckless, courts may also award punitive damages designed to punish and deter.

    • Current and future medical expenses, including surgery, rehabilitation, and ongoing care
    • Lost wages and diminished future earning capacity
    • Pain and suffering and emotional distress
    • Property damage and vehicle replacement
    • Loss of consortium and companionship for surviving family members
    • Wrongful death damages including funeral costs and future financial support
    • Punitive damages where carrier conduct was egregious or reckless

Every client deserves direct access to their attorney, clear communication, and a team that treats their case like it matters, because it does.

    — Truck Accident Law Firm Nevada

    Why Acting Quickly Matters

Trucking companies and their insurers mobilize rapid response teams within hours of a serious crash. These teams work to preserve evidence that helps the carrier while minimizing or destroying evidence that could help you. ECM black box data is frequently overwritten on a rolling 30-day cycle. Dashcam footage may be deleted. Driver logs can disappear. The days following a crash are often the most critical period in the entire case.

When you call our office, one of the first actions we take is to send a formal legal hold letter to the carrier, demanding preservation of all electronic and physical evidence. That single step can be the difference between a case that is won and one that cannot be proven.

    Frequently Asked Questions

    Las Vegas Truck Accident FAQs

Answers to the questions our clients ask most often. To find out more about how we can help you, call us at 702-702-6903.

No. Our firm works on a contingency fee basis, which means you pay nothing out of pocket to hire us. We advance the costs of investigating your case, retaining consultants, and preparing for trial. Our fee comes only from the compensation we recover for you, whether through a settlement or a jury verdict. If we do not win your case, you owe us nothing for our time or the resources we invested in building it. This arrangement lets you pursue a truck accident claim without worrying about hourly billing or upfront retainers, and it means our incentives are aligned with yours from the very first call. We offer a free consultation before you commit to anything, so you can understand your options with no financial risk.

Truck accident cases involve layers of complexity that a typical car accident claim does not. Commercial trucks are regulated by the Federal Motor Carrier Safety Administration, which sets rules for driver hours, vehicle maintenance, and cargo loading. Multiple parties can share liability, including the driver, the trucking company, a freight broker, a maintenance contractor, or the vehicle manufacturer. Trucking companies also carry higher insurance policy limits, and their insurers typically deploy rapid response teams to investigate and defend the claim within hours of a crash. Evidence like black box data, electronic logs, and dashcam footage can be lost quickly unless it is formally preserved. Because of these factors, truck accident cases usually require a more thorough investigation, a working knowledge of federal trucking regulations, and faster action after the crash than a standard car accident claim.

In Nevada, the general deadline to file a personal injury lawsuit is two years from the date of the crash, under NRS 11.190(4)(e). If a loved one died as a result of the crash, a wrongful death claim generally has the same two-year deadline, running from the date of death rather than the date of the accident. Certain circumstances, such as delayed discovery of an injury or claims involving a government entity, can change these timelines, so it is important to speak with an attorney early. Missing the filing deadline can permanently bar you from recovering compensation, no matter how strong your case is. Acting quickly also helps preserve evidence like ECM data and driver logs, which can be lost within days of a crash.

Nevada follows a modified comparative negligence rule under NRS 41.141. If you are found 50% or less at fault for the crash, you can still recover compensation, but your award will be reduced by your percentage of fault. For example, if you are awarded $100,000 and found 20% at fault, you would recover $80,000. If you are found 51% or more at fault, Nevada law bars you from recovering any compensation. Insurance companies and trucking carriers often try to shift blame onto the injured party to reduce or avoid paying a claim, so it is important to have your fault percentage evaluated carefully. An attorney can help gather evidence to make sure fault is assigned fairly and your compensation is not unfairly reduced.

Yes. While our office is based in Las Vegas, we represent truck accident victims throughout Nevada, including Henderson, North Las Vegas, Reno, and communities along major freight corridors like I-15, I-80, and US-95. Truck accidents often involve carriers based outside Nevada, and cases can require coordination across multiple jurisdictions. We are equipped to handle claims regardless of where in the state the crash occurred, and we can conduct initial consultations remotely by phone or video if traveling to our office is not convenient. If you were injured in a commercial trucking crash anywhere in Nevada, reach out so we can review the details of your situation and explain your legal options.

Medical bills do not have to wait for your case to resolve. Depending on your situation, bills may be covered through your own health insurance, personal injury protection or MedPay coverage if you have it, or through a letter of protection, where a medical provider agrees to treat you and wait for payment until your case settles. Some providers will place a lien against your future settlement instead of requiring payment upfront. We help clients understand which options apply to their situation and work to make sure medical liens and bills are properly accounted for when your case resolves, so you are not caught off guard by outstanding balances. If collectors or insurers contact you about medical debt during your case, let us know so we can help manage that communication.

There is no fixed timeline for a truck accident case, since it depends on factors like the severity of your injuries, whether liability is disputed, and whether the case settles or proceeds to trial. Straightforward cases with clear liability and full insurance coverage may resolve in several months. Cases involving catastrophic injuries, multiple liable parties, or an insurer unwilling to offer a fair settlement can take considerably longer, sometimes over a year, particularly if the case goes to trial. We do not rush a settlement just to close a case quickly. Instead, we build your case fully before negotiating, and we are prepared to take a case to trial if the insurer will not offer fair compensation. We can give you a more specific estimate after reviewing your situation.

First, prioritize safety and seek medical attention, even if your injuries do not seem severe at first. Call the police so an official report is created, and avoid discussing fault at the scene. If you are able, take photos of the vehicles, the road, any visible injuries, and the truck’s company markings and license plate. Get contact information from witnesses if possible. Avoid giving a recorded statement to the trucking company’s insurer before speaking with an attorney, since these statements are often used to reduce your claim. Contact an attorney as soon as possible, since trucking companies often send rapid response teams to investigate immediately, and key evidence like black box data can be lost within days.
